According to the 10-page fraud lawsuit, the company in late February 2023 began charging the plaintiff a monthly fee of approximately $114.01 for organic waste processing.
The plaintiff, who the suit says already pays Republic for weekly waste and recycling removal, claims he was charged the added fee at issue despite the fact that his shop does not produce organic waste, and Republic, which provides garbage collection and recycling services to the city and county of San Diego, does not in fact pick up or process any such materials from his business.
As the suit tells it, the plaintiff informed Republic numerous times that its organic waste processing service was unnecessary for his business and, importantly, not being provided, and requested that the company stop charging him the associated monthly fee.
However, as of the date of the filing, Republic Services has neither refunded nor credited the plaintiff any amount, the case shares.
The Republic Services organic waste lawsuit looks to represent any businesses in the city of San Diego—excluding those ineligible for a de minimis waiver—charged by the defendant for organic waste processing but not provided such services at any time since January 1, 2023.
