A proposed class action has been filed against Receivables Performance Management, LLC claiming it sent collection letters that violated several provisions of the Fair Debt Collection Practices Act.

A proposed class action lawsuit has been filed against Receivables Performance Management, LLC claiming it sent collection letters that violated several provisions of the Fair Debt Collection Practices Act (FDCPA). The plaintiff in the case says he received two letters from the defendant regarding an account with Verizon Wireless. The first letter allegedly informed the man that he owed $0.00 in “Fees.” Although the amount was zero, the suit argues, the mention of “Fees” left open the possibility that additional charges might be added in the future. The complaint claims the defendant was not authorized to add “Fees” to the plaintiff’s account and that letter's language amounted to a false threat.
The plaintiff claims he received a second collection letter from the defendant offering him a settlement that must be paid by a specific date. The case alleges that the offer was actually available at any time and that the false deadline was meant to induce a sense of urgency in the plaintiff and pressure him into settling his account.
