Anderson v. Landry’s, Inc.
Filed: September 28, 2017 ◆§ 1:17-cv-05691
A blind man has filed a proposed class action lawsuit against the company that operates Rainforest Café and its corresponding website, alleging the site is unlawfully inaccessible to visually impaired users.
New York
A blind man has filed a proposed class action lawsuit against the company that operates Rainforest Café and its corresponding website, alleging the site is unlawfully inaccessible to visually impaired users. Citing alleged violations of the Americans with Disabilities Act, the complaint claims the plaintiff attempted to make an online reservation at one of the defendant’s restaurant locations and was unable to complete the transaction due to the website’s incompatibility with his screen-reading software. The suit argues that the defendant denies blind users “full and equal access” to its online goods and services, including the following:
- information about restaurant locations, hours, and phone numbers;
- a Wild Bunch Kids Zone tab, displaying a kid’s menu and other activities for children who dine with their families at the restaurant;
- information about making a reservation;
- information about the restaurant’s social networks;
- information about the restaurant’s e-mail Club;
- information about parties and group events;
- information about the restaurant’s testimonials and employment opportunities; and
- an online shop displaying many of the products and services available at the restaurant.
The suit further notes that the plaintiff claims he was unable to visit the defendant’s physical restaurant to make a reservation in person because he was unable to find the location and hours online.
