QuickRecruit faces a lawsuit that claims it sent automated text messages to consumers’ cell phones without securing express written consent to do so.
QuickRecruit, LLC faces a proposed class action over its alleged practice of sending automated text messages to consumers’ cell phones without securing express written consent to do so.
Per the lawsuit, the staffing company has violated the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system to “bombard” consumers with non-emergency text message ads despite failing to obtain their consent to do so.
The plaintiff, who says he has never done business with QuickRecuit, claims to have received the following text message from the company on December 21, 2020:
According to the case, the plaintiff had not sought service from QuickRecuit and was “annoyed” by the message, which he believes was sent using an automatic telephone dialing system. Per the case, the plaintiff never provided express written consent to be contacted via text message.
The lawsuit claims the nature and character of the text indicates it was sent without any human involvement and likely received by other consumers. Per the complaint:
“The language in the message was automatically generated and inputted into a pre-written text template without any actual human intervention in the drafting or sending of the message; the same exact message was sent to thousands of other consumers.”
The case looks to cover anyone to whose cell phone the defendant sent or caused to be sent a text message using an automatic telephone dialing system within the last four years and until the date the class is certified.
