A proposed class action citing violations of Florida’s Deceptive and Unfair Trade Practices Act (FDUTPA) has been filed against Quest Diagnostics Incorporated. The 30-page lawsuit claims the defendant unlawfully engages in a practice called “balance billing.” According to the suit, this occurs when Quest Diagnostics sends collection letters directly to consumers to collect money for “the difference between what it normally charges for testing and the amount allowed under Florida’s workers’ compensation law.”
The lawsuit asserts that Florida’s workers’ compensation law does not, in fact, allow Quest diagnostics to bill consumers for this difference. The defendant’s “balance billing” practice, the lawsuit says, “not only violates patient trust by sending collection letters for amounts not owed, but perhaps more importantly, creates yet another barrier for patients in need of medical care.”
