At least 15 lawsuits have been filed so far against medical testing company Quest Diagnostics Incorporated over a data breach that reportedly exposed the personal information of nearly 12 million customers.
New Jersey
At least 15 lawsuits have been filed so far against medical testing company Quest Diagnostics Incorporated over a data breach that reportedly exposed the personal information of nearly 12 million customers.
Billing collections firm American Medical Collection Agency (also known as Retrieval-Masters Creditors Bureau, Inc.) reportedly informed Quest and Optum360 Services, Inc. in May 2019 that its web portal had been breached, allowing an unauthorized party access to millions of customers’ credit card numbers, Social Security numbers, and personal medical information, among other confidential data. It wasn’t until June 3, 2019, however, that Quest revealed the existence of the breach to the public in an SEC filing, the suits say.
Though the breach was reportedly discovered and reported to AMCA in February 2019 by cyber threat monitoring firm Gemini Advisory, the consumers themselves were not warned until more than three months later, the lawsuits attest.
The cases claim the defendants – Quest, AMCA, and Optum360 – failed to uphold their duty to protect customers’ personal information and exposed them to an increased risk of identity theft.
Many of the lawsuits have been consolidated into a multi-district litigation (MDL) styled In Re: American Medical Collection Agency, Inc., Customer Data Security Breach Litigation.
