The 44-page case says Quaker, one of the country’s largest window and door manufacturers, notified affected individuals around December 29, 2023 that it had experienced a “network disruption” in late November 2023. According to the lawsuit, Quaker later determined that an unauthorized actor accessed its computer network on November 25 of last year.
The complaint alleges that the defendant’s inadequate cybersecurity is to blame for the incident, which compromised potentially thousands of individuals’ names, addresses and Social Security numbers.
“This unencrypted, unredacted [personally identifiable information] was compromised due to [Quaker’s] negligent and/or careless acts and omissions and their utter failure to protect employee and customers’ sensitive data,” the suit says.
Quaker’s allegedly “poor” data security measures run contrary to representations made in its privacy policy, which assures individuals that the company “strives to take reasonable and appropriate steps to protect your personal information from unauthorized access, use or disclosure,” the filing shares.
The plaintiff, a former Quaker employee living in Missouri, says she received notice from the company in December 2023 informing her that her information was involved in the data breach. Like other victims, the woman now faces a heightened risk of identity theft and fraud for years to come, the suit stresses.
In addition, “[t]he data breach has caused [the plaintiff] to suffer fear, anxiety, and stress, which has been compounded by the fact that [Quaker] has still not fully informed her of key details about the data breach’s occurrence,” the case says, claiming that the company’s notice has omitted details about the root cause of the incident, the vulnerabilities exploited by hackers or the steps it has taken to prevent a future breach from occurring.
The woman says she anticipates spending “considerable” time and money “on an ongoing basis” to mitigate the effects of the cyberattack.
The lawsuit looks to cover anyone whose personal information was compromised in the data breach first announced by Quaker in December 2023.
