PurFoods Settlement: Mom’s Meals Data Breach Lawsuit Resolved for $4.25 Million

The company behind Mom’s Meals faces a class action over a data breach that reportedly occurred between January 16 and February 22, 2023.
A $4.25 million settlement has been reached to end a proposed class action lawsuit against PurFoods that alleged the meal delivery company, which does business as Mom’s Meals, failed to prevent a 2023 data breach.

The proposed deal, submitted on October 25, 2024, now awaits preliminary approval from the court. If approved, the PurFoods settlement would cover more than 1.2 million United States residents who were sent notice that their personal information was accessed, stolen or compromised in the PurFoods data breach, which took place between January 16 and February 22, 2023.
To receive benefits from the deal, class members must submit a valid, timely claim form online when the official settlement website—PurFoodsDataSettlement.com—goes live.
Class members can file a claim form to receive a pro-rated cash payment, estimated to be about $75, court documents state. Alternatively, a claimant can elect to receive up to $5,000 in reimbursement for documented, out-of-pocket expenses incurred as a result of the PurFoods data breach, such as unreimbursed losses related to fraud, identity theft or credit freezes.

Class members can also submit a claim form for three years of free credit monitoring and insurance services.
Typically, class members begin to receive benefits from a class action settlement only after the deal receives final approval from the court and any appeals or objections are resolved.

The PurFoods data breach lawsuit, filed in September 2023, claimed the company failed to take the proper steps to protect customers’ and employees’ sensitive information from unauthorized access. As part of the proposed settlement, the defendant has also agreed to implement certain cybersecurity procedures to better protect the data within its care.
According to court documents, 10 class action suits were ultimately filed over the PurFoods data breach. The cases were consolidated in October 2023.
