The operating entities of a Subway sandwich shop in California are facing a class action alleging they violated the Fair and Accurate Credit Transactions Act (FACTA) by illegally printing the expiration dates of customers’ credit cards on receipts. The plaintiff claims defendants McCan Inc., which owns the Subway, and Doctor’s Associates Inc.—the business entity that accepts customers’ credit/debit card transactions—acted irresponsibly by handing the plaintiff a receipt that included the expiration date of his credit card.
The proposed class seeks to cover anyone within the United States who received an electronically printed receipt at the point of sale or transaction with the defendants within the last two years that displayed:
- More than five digits of the individual’s credit or debit card number, and/or
- The expiration date of the individual’s credit or debit card
