Prosperum Capital LLC (which does business as Prosperum Funding) is facing claims that it violated the federal Telephone Consumer Protection Act by placing illegal autodialed telemarketing calls to consumers’ cell phones.

Prosperum Capital LLC (which does business as Prosperum Funding) is facing claims that it violated the federal Telephone Consumer Protection Act by placing illegal autodialed telemarketing calls to consumers’ cell phones. The plaintiff says he received two calls from the defendant pitching its services as a business funding provider even though he never consented to receive the calls or expressed an interest in Prosperum. On top of that, he insists his cell phone number had been on the National Do Not Call Registry for at least 30 days prior to the first call. The complaint argues the following:
“[The plaintiff] and the other call recipients were harmed by these calls. They were temporarily deprived of legitimate use of their phones because the phone line was tied up, they were charged for the calls, and their privacy was improperly invaded. Moreover, these calls injured [the plaintiff] because they were frustrating, obnoxious, annoying, were a nuisance, and disturbed the solitude of [the plaintiff and the proposed class].”
