According to Propark’s data breach notice letter, the company learned on January 18, 2024 that its IT network had experienced a “data security incident.” Per the notice letter, a subsequent investigation determined that, between January 15 and January 18, an unauthorized third party had accessed and potentially exfiltrated certain data stored on the network.
The 41-page Propark data breach lawsuit says that the cyberattack may have impacted individuals’ names, dates of birth, Social Security numbers and other data shared with the company in connection with their employment, including dependent information.
Despite the prevalence of public warnings about cybersecurity incidents, Propark failed to implement necessary data security protocols to protect the personal information in its care, the case claims. Indeed, the company maintained the data unencrypted, unredacted and “in a dangerous condition” in its computer systems, the class action suit alleges.
The filing charges that the cyberattack could have been prevented had the defendant properly secured and encrypted its servers and the confidential employee data stored therein. As it is, the sensitive information is now “in the hands of data thieves,” where it can be used to perpetrate fraud, identity theft and numerous other illegal schemes, the complaint stresses.
The plaintiff, a New York resident, says he received notice from Propark in early September 2024 that his private data had been compromised in the breach. Like other victims, the man now faces a lifelong risk of being targeted for cybercrimes and must vigilantly monitor his financial accounts to protect himself, the case contends.
The Propark lawsuit looks to represent anyone in the United States whose private information was accessed and/or acquired by an unauthorized third party as a result of the data breach.
