Filed in Wisconsin, the lawsuit claims the defendant sent the plaintiff a collection notice that listed Capital One, N.A. as the creditor at the top of the letter, yet named Kohl’s Department Store as the creditor at the bottom. The defendant’s alleged misrepresentation of the original creditor’s identity is materially false and misleading and could lead the unsophisticated consumer to mistakenly contact the wrong entity with questions about the debt or payments, the lawsuit argues.
