Two Wisconsin women have put their names on a proposed class action against Progressive Financial Services, Inc. claiming the debt collector failed to clearly identify their creditors.

Two Wisconsin women have put their names on a proposed class action against Progressive Financial Services, Inc. claiming the debt collector failed to clearly identify their creditors. The first plaintiff says she received a collection letter from the defendant that named Capital One N.A. as her creditor but also indicated that “KOHLS DEPARTMENT STORE” had placed her alleged debt with Progressive for collection. The suit argues that only the creditor would have the authority to send the account to collections and that the letter’s statements confused the plaintiff as to whom the purported debt was owed.
Similarly, the second plaintiff allegedly received a debt collection letter identifying her creditor as Capital One. Her notice supposedly stated that “KOHLS DEPARTMENT STORE” would accept a settlement of 60 percent of her debt and that “neither Progressive Financial Services, Inc. nor KOHLS DEPARTMENT STORE is under any obligation to renew this offer.” The suit argues that, again, the defendant was unclear as to which entity – Capital One or Kohl’s – the plaintiff owed the alleged debt.
