From Arizona district court comes a proposed class action claiming defendant Prog Leasing, LLC violated the Telephone Consumer Protection Act (TCPA) by using automatic dialing equipment to place calls to proposed class members’ cell phones. The plaintiff claims the defendant placed numerous auto-dialed calls to his cell phone within the last four years from several different numbers. When the plaintiff did not answer the phone, the lawsuit says, the defendants left messages using a pre-recorded voice. Even after being told to stop, the defendant allegedly kept calling the plaintiff.
