A proposed class action filed in New York claims defendant Professional Bureau of Collections of Maryland, Inc. violated the Fair Debt Collection Practices At (FDCPA) by requiring the plaintiff to dispute the validity of her debt in writing. The lawsuit says that within the FDCPA there is no requirement mandating that a consumer dispute his or her debt in writing, and that suggesting so in a collection notice is a violation of federal law.
“It is a violation of the FDCPA to include language in the letter that, when examined from the perspective of the least sophisticated consumer, leads the least sophisticated consumer to believe that her dispute must be in writing,” the lawsuit alleges.
