A proposed class action lawsuit alleges National Presto Industries, Inc. has misled consumers by exaggerating the capacity of its 12-cup coffee percolator.

The 13-page fraud lawsuit contends that although Presto’s electric coffee percolator is advertised on Amazon.com as having a 12-cup capacity, the product can only hold approximately 64 fluid ounces, or eight standard cups.
According to the class action suit, the coffee percolator’s actual capacity is based on a five-fluid-ounce cup rather than a standard cup’s eight fluid ounces. This fact is disclosed only in a disclaimer found in the product’s installation manual, user guide and other accompanying documents, which state that “[o]ne cup is approximately 5 ounces brewed coffee,” the case relays. The complaint asserts that most consumers do not see this disclaimer, as they have no reason to click the hyperlinks on the product’s listing that would redirect them to the documents containing this key information.
The filing claims that the company has overcharged shoppers for the Presto coffee percolator given the product would have commanded a lower price had its capacity been accurately represented.
The Presto coffee percolator lawsuit looks to represent anyone who purchased the product through National Presto Industries’ Amazon.com listing within the applicable statute of limitations period.
