A $1.7 million settlement has been reached to resolve a proposed class action lawsuit that alleged Precision Dialogue Direct and its parent company, RR Donnelley, violated Illinois employees’ privacy rights by collecting their fingerprints for timekeeping purposes without providing statutory disclosures and obtaining their informed consent.

The deal covers anyone who worked at one of RR Donnelley’s locations in Illinois, including, but not limited to, Precision Dialogue, and registered for or used a fingertip-scan timekeeping system in connection with their work for the defendants from August 26, 2017 through January 29, 2024.
An estimated 2,576 individuals are covered by the Precision Dialogue Direct settlement, court documents say.
To receive a cash payment from the deal, class members must submit a valid claim form online or by mail by December 10, 2024. Head to this page to file a claim form online. You’ll need the notice ID and PIN provided in the postcard settlement notice you received.

According to the settlement site, class members who file timely, valid claim forms are expected to receive approximately $430 each, although this amount may change depending on several factors, such as deductions for attorneys’ fees, costs and the plaintiff’s incentive award.
The RR Donnelley settlement was preliminarily approved by the court in July 2024. The parties now await a final approval hearing set for January 8, 2025. If the deal is ultimately approved, class members should expect to receive their cash payments within 14 days after the effective date of the settlement.
“If there is an appeal of the Settlement, payment may be delayed,” the site says.
The initial lawsuit was filed in August 2022 by a Precision Dialogue employee who claimed the company required him and other workers in Illinois to clock in and out by scanning their fingerprints into a machine. The case alleged that Precision Dialogue, in violation of the Illinois Biometric Information Privacy Act, failed to obtain employees’ written permission to collect their fingerprint scans and never provided them with information about how such data would be used.
