Update – Lawsuit Voluntarily Dismissed
Pop Sells, LLC is on the receiving end of a proposed class action lawsuit in which the plaintiff claims the company engaged in unlawful and unsolicited marketing.
According to the complaint, the defendant operates a website through which consumers can buy and sell boats. The plaintiff says he received unsolicited text messages from Pop Sells in early June 2018 in which the company encouraged him to utilize its services should he be looking to sell a boat.
“At no point in time did Plaintiff provide Defendant with his express written consent to be contacted using an [automatic telephone dialing system],” the suit claims.
The case adds the defendant allegedly utilized a “long code” 10-digit phone number designed to deceive recipients into believing a mass-transmitted text message was “personalized and sent from a telephone number operated by an individual.”
