A consumer claims in a lawsuit that Planet Fitness sent at least one unsolicited marketing text message.
A Florida consumer has filed a proposed class action lawsuit against Planet Fitness Inc. over its alleged practice of sending unsolicited text messages to promote its gyms.
According to the lawsuit, Planet Fitness sent the plaintiff in October 2018 via automatic dialing technology a text message in which it thanked her for being a member and stated that if she showed the text at her local gym, she could receive a free water bottle. The plaintiff claims in the suit that she never expressly consented to be contacted by Planet Fitness by way of an automatic dialer.
The lawsuit cites alleged violations of the Telephone Consumer Protection Act (TCPA).
