A blind Florida man is the plaintiff in a case claiming PlanetFitness.com is not compliant with Americans with Disabilities Act regulations.
A class action complaint filed in Florida hopes to take Defendant Planet Fitness, Inc. to task for allegedly failing to “design, construct, maintain, and operate” its website—PlanetFitness.com—in a manner fully accessible to blind and hard-of-sight individuals. Citing possible Americans with Disabilities Act (ADA) violations, the proposed lawsuit claims PlanetFitness.com’s alleged inaccessibility deters blind consumers from visiting the company’s brick-and-mortar locations since certain information—gym locations, hours and schedules, membership information and pricing, and discounts and promotions, among other services—cannot be interpreted by commonly used screen reading software.
The case seeks monetary damages and a permanent injunction requiring Planet Fitness to re-evaluate and revise their policies, practices, and procedures towards individuals with disabilities.
