Following up on previous cases, a class action seeks additional damages for a plaintiff who was allegedly subject to three unconstitutional strip searches.
New York’s Nassau County and the Nassau County Correctional Center are the defendants in a proposed class action lawsuit over the latter’s alleged blanket policy of strip searching all individuals admitted to the facility between May 20, 1996 and June 1, 1999.
This lawsuit, filed on October 20, stems from three previous cases over the defendants’ conduct—In re: Nassau County Strip Search Cases, Nos. CV-99-2126 (DRH), CV-99-2844 (DRH), and CV-994238—for which Nassau County and Nassau County Correctional Center years ago conceded liability. The complaint says the plaintiff opted to be a member of the class certified for the aforementioned lawsuits and, as a member, was entitled to receive “general damages” of $500 per strip search. The court overseeing the case stipulated that any “other damages” beyond the per-search award could be pursued through other lawsuits separate from the class action pursuant to a statute of limitations.
The case claims that the plaintiff was unconstitutionally strip searched after three arrests for misdemeanor offenses between 1997 and 1998.
