A consumer says he was left unsure of how much needed to be paid on his debt at any point in the future thanks to a Pinnacle Recovery collection notice.
Pinnacle Recovery is the defendant in a proposed class action wherein the plaintiff claims the company mailed him a collection notice in which it unlawfully failed to provide information necessary to determine how much needs to be paid to resolve his debt at any given moment in the future. Filed over suspected Fair Debt Collection Practices Act (FDCPA) abuses, the lawsuit decries the defendant for allegedly failing to detail the amount of interest, the applicable interest rate, and the date of accrual of interest. Combined, the defendants’ alleged missteps constitute a failure to clearly convey the amount of debt as required by the FDCPA, the lawsuit argues.
