Phillips & Cohen Associates, Ltd. is facing a proposed class action lawsuit that claims it failed to accurately inform consumers of their right to dispute their alleged debts. The plaintiff says he received a collection letter from the defendant that instructed him to call its telephone number “with any questions or to discuss payment options.” The suit argues that this language overshadows the validation statement in the letter requiring consumers to submit disputes in writing. According to the complaint, Phillips & Cohen Associates implies that disputes may be made orally over the phone – which the suit argues is incorrect – to discourage consumers from invoking their rights under the Fair Debt Collection Practices Act and causing collection activities to cease.
