Mcintyre v. Rentgrow, Inc.
Filed: September 5, 2018 ◆§ 2:18cv3793
A proposed class action accuses Yardi Resident Screening of furnishing consumer reports containing inaccurate eviction information.
A proposed class action out of Pennsylvania federal court accuses Yardi Resident Screening of furnishing consumer reports containing inaccurate eviction information.
The plaintiff, a Philadelphia consumer who was “forced to vacate her previous apartment because of mold,” alleges her application to rent housing in July 2017 was rejected as a result of an inaccurate report provided to the apartment complex by the defendant. According to the complaint, the reporting agency’s screening of the plaintiff included 11 inaccurate items of eviction information, including withdrawn complaints and satisfied or vacated judgments.
The defendant purchased public records information from private vendors, the case claims, instead of courthouses or government offices, where records contain “the most up-to-date information available.” The complaint argues the reporting agency violated the Fair Credit Reporting Act (FCRA) by failing “to follow reasonable procedures to assure maximum accuracy of eviction information contained in tenant screening reports prepared about Plaintiff.”
