A South Carolina man claims in a proposed class action lawsuit that defendant PhD Fitness, LLC systematically misleads consumers.
A South Carolina man claims in a proposed class action lawsuit that defendant PhD Fitness, LLC systematically misleads consumers with the marketing of its popular Pre-JYM and Post-JYM workout supplement products. The defendant makes “multiple and prominent” misrepresentations regarding the purported benefits of its sport supplements, claims so deceptive that they amount to consumer fraud, the case alleges.
The complaint takes particular issue with the face of PhD Fitness, Jim Stoppani, who allegedly purports his expertise in nutritional supplements in the company’s advertising and marketing materials. Although he is not named as a defendant in the suit, Stoppani and his role with the company’s sales efforts are a large part of the overall problem, the plaintiff claims:
“However, although Stoppani consistently claims that all of the ingredients in his products are scientifically supported and dosed properly, they are not. In reality, Stoppani and [the defendant] deceive consumers in the exact same way as their competitors.”
