A Florida consumer has filed a proposed class action against Peterson’s Harley Davidson of Miami, L.L.C. in which he accuses the company of sending unsolicited marketing text messages promoting its motorcycles and other merchandise.
The plaintiff claims that between November 2017 and April 2018, the defendant sent at least five promotional text messages to his cell phone without his consent. According to the lawsuit, the text messages violated the Telephone Consumer Protection Act because they were sent without the prior express consent of the recipients. The suit argues that the unsolicited, automatically generated texts aggravated the plaintiff and were an invasion of his privacy.
