Persolve Legal Group, LLP is facing another class action filed by a New York consumer who argues that the debt collector’s March 2018 collection notice failed to contain required disclosures.
Persolve Legal Group, LLP is facing another class action filed by a New York consumer who argues that the debt collector’s March 2018 collection notice failed to contain required disclosures necessary to determine how much needs to be paid to resolve the debt at any given point in the future. The letter, according to the complaint, should have specified the amount of interest the plaintiff owed, as well as whether additional interest would be added, the rate at which it was accruing, the date of accrual, and any relevant information concerning other additional fees. Because this information was missing, the case argues, the defendant effectively failed to communicate the plaintiff’s debt amount “without ambiguity from the perspective of the least sophisticated consumer.”
