Pennsylvania Man Claims SafeLink Placed ‘Over 100’ Illegal Robocalls to His Landline

A Pennsylvania man claims in a proposed class action lawsuit that TracFone Wireless, Inc. placed over 100 unlawful robocalls to his landline.

TracFone Wireless, Inc. has been named as the defendant in a proposed class action lawsuit in which a Pennsylvania man claims the telecommunications carrier placed over 100 unlawful robocalls to his landline.
TracFone, which does business as SafeLink Wireless, offers free or discounted telecommunications services to low-income consumers as part of the Federal Communications Commission’s “Lifeline” program, the lawsuit explains. Lifeline subscribers, the case says, receive a discount on their monthly telephone, broadband internet or bundled voice and internet service from participating providers.
According to the case, SafeLink has placed calls that utilize “an artificial or prerecorded voice” to consumers’ residential landlines without securing their prior express consent to do so. The plaintiff claims to have received over 100 robocalls from SafeLink beginning as early as April 2016. The complaint provides the following as an apparent example of one such call that utilized a prerecorded voice:
“Hi, this is Stacy from SafeLink, a service of TracFone calling with a special message for SafeLink customers. If you no longer wish to receive these messages please call 1-888-449-3610. If you have extra change in your pocket from taxes, then take advantage of this great offer for our SafeLink customers. Now you can get 350 minutes for only $10. Just go to your nearest Dollar General Store or call 1-888-449-3610 to have the airtime added to your phone. Again, get 350 minutes for only $10 by going to Dollar General or calling 1-888-449-3610. Thanks for being a SafeLink customer and have a great day.”
The plaintiff claims he has never been a SafeLink customer nor provided the company with permission to call him using a prerecorded voice. Moreover, the man says his phone number has been listed on the National Do Not Call Registry since February 2014. According to the case, the plaintiff has “repeatedly” attempted to request that the calls cease, but “to no avail.”
The lawsuit claims SafeLink “fails to take the necessary steps” to ensure that calls are only placed to consumers who have provided their consent and instead “simply ignores the law.” The case points out that SafeLink has previously been sued at least twice over alleged violations of the Telephone Consumer Protection Act.
