Gowins et al v. Pella Corporation

A new class action filed in Alabama claims Pella's Architect and Designer series windows come with a hidden defect that allows water to leak.
A new class action filed in Alabama claims Pella’s Architect and Designer series windows come with a hidden defect that allows water to leak behind the products’ aluminum cladding. This problem, the 40-page suit alleges, can cause premature wood rot and other damage to the structure of the windows. The complaint then notes that the issue may not be immediately visible to consumers until years after installation. As a result of the defect, plaintiffs say, “the wood rot will progress to the frames and adjoining structure unless repaired and replaced before the rot progresses to those components.”
Perhaps the most damning allegation put forth by the suit is that Pella, rather than acknowledge the problem, “unilaterally drafted a limited warranty” written to provide no actual remedy to consumers who bought the windows.
