Paul Michael Marketing Service is facing a class action alleging it violated federal debt collection laws in notices sent to consumers.

A proposed class action alleges defendant Paul Michael Marketing Service Inc., which operates as Paul Michael Associates, sent New Jersey consumers collection notices that contained one or more violations of the Fair Debt Collection Practices Act (FDCPA). The plaintiff claims she received a notice from the defendant in June 2016 for an alleged $1199.30 balance owed to Shiel Medical Labs. Paul Michael Associates, however, allegedly failed to clearly identify in that communication whether “RE: Shiel Medical Labs” indicated the name of the creditor to whom the balance was owed or if Shiel Labs was the original creditor. The case argues the language used in the notice violates the FDCPA because it is unclear whether Paul Michael Associates is the creditor and to whom the balance is payable.
