Express Scripts, Inc. is facing a proposed class action lawsuit that claims it unlawfully charged patients for copies of their medical records.
Express Scripts, Inc. is facing a proposed class action lawsuit that claims it unlawfully charged patients for copies of their medical records. The plaintiff says he requested a copy of his pharmacy records from the defendant and was charged $75.00 for “data processing” when the records “should have been free.” The suit argues that under Kentucky state law, healthcare providers are required to provide, upon a patient’s written request, a copy of his or her medical records “without charge.”
This suit has been removed from state to federal court in Kentucky.
