The 10-page lawsuit was filed by a Florida consumer who claims to have received an email from noreply@paramountplus.com at 9:50 PM in July 2022 advising them that the company had been “unable to process [their] recent payment, and [their] Paramount+ subscription has expired.”
The complaint says that under the Florida Consumer Collection Practices Act (FCCPA), entities collecting consumer debts are prohibited from communicating with a debtor between 9:00 PM and 8:00 AM in the debtor’s time zone without their consent.
According to the case, the defendant failed to secure the plaintiff’s permission before attempting to collect a debt from them outside of the hours allowed by the FCCPA.
The lawsuit seeks to cover anyone in Florida who was sent an electronic mail communication from Paramount Plus or someone on the company’s behalf between 9:00 PM and 8:00 AM in connection with the collection of a consumer debt.
