Pape-Dawson Engineers Facing Class Action Over February 2022 Data Breach

Pape-Dawson Engineers faces a class action over a February 2022 data breach during which consumers’ personal information was reportedly compromised.
Pape-Dawson Engineers, Inc. faces a proposed class action over a February 2022 data breach during which the personal information of more than 10,000 consumers was reportedly compromised.
The 41-page lawsuit alleges the Texas engineering firm maintained consumers’ sensitive data “in a reckless manner” that left the information “vulnerable to a cyberattack.” Per the case, consumers whose information was exposed during the incident now face a lifetime risk of identity theft and fraud given that their private data is “now in the hands of data thieves.”
The plaintiff in the case is a former Pape-Dawson employee who says he received a letter, dated June 21, 2022, that stated the company had experienced a cybersecurity incident that may have compromised “the privacy of your personal information.” According to the suit, the data breach notice disclosed that Pape-Dawson had become aware of “suspicious activity” on its servers on February 21, 2022 and, after an investigation, determined that an unauthorized actor had gained access to consumer information from February 21 to 25 of this year.
The case says the defendant’s data breach notice did not disclose which specific information had been compromised. Per the suit, the breach involved personal data belonging to current and former Pape-Dawson employees and possibly other consumer information disclosed to the company by its customers.
Although Pape-Dawson had determined by late April whose personal information was exposed during the breach, the company “[i]nexplicably” waited another three months to begin notifying those who were affected, the lawsuit alleges.
Moreover, the case claims that the defendant has so far “done nothing” to provide relief to data breach victims other than offering 24 months of fraud and identity monitoring services, which the suit contends is insufficient to compensate consumers for the damages they’ve incurred and fails to account for the “threat of misuse” they’ll face for the rest of their lives.
The lawsuit looks to represent anyone whose private information was compromised as a result of the data breach for which Pape-Dawson Engineers provided notice in June 2022.
