A Florida consumer claims in a proposed class action filed this week that civil recovery law firm Palmer Recovery Attorneys, PLLC used a prohibited automatic dialing system to place calls to consumers’ cell phones without receiving prior express consent. Citing alleged violations of both the Telephone Consumer Protection Act (TCPA) and Fair Debt Collection Practices Act (FDCPA), the plaintiff claims the defendant called her numerous times attempting to collect a debt that was, in fact, owed by an entirely different person. According to the complaint, the plaintiff obtained a new cell phone number in February 2017 and began receiving the unwanted calls only days later. The plaintiff contends that she spoke with one of the defendant’s agents over the phone on numerous occasions to demand they stop calling, but the calls allegedly persisted.
