Arcadia Recovery Bureau, LLC is on the receiving end of a proposed class action lawsuit that alleges the debt collector violated several provisions of the Fair Debt Collection Practices Act (FDCPA) in a collection letter sent to a Pennsylvania consumer. The plaintiff in the case says she received a collection notice from the defendant that stated its name – and therefore its identity as a debt collector – on the outside of the envelope. The suit argues that the FDCPA prohibits debt collectors from using “any language or symbol” other than an address on an envelope sent to a consumer.
The plaintiff further alleges that the letter instructed her to call the defendant if she disputed the debt, which the suit says “is not adequate” for activating the FDCPA protections connected with a dispute and is therefore misleading to the unsophisticated consumer.
