A proposed class action lawsuit stemming from 'improper and violative debt collection practices' has been filed against law firm Overton, Russell, Doerr & Donovan.

A proposed class action lawsuit stemming from “improper and violative debt collection practices” has been filed in New York against law firm Overton, Russell, Doerr & Donovan, LLP. The complaint alleges the defendant violated the Fair Debt Collection Practices Act (FDCPA) when it sent the plaintiff a collection notice that issued a false threat of legal action should the plaintiff not satisfy the stated debt.
“In proof that no legal action was intended as implied in the letter, no lawsuit has been commenced against the plaintiff as of the date set forth below which is five months after the date that legal action was supposed to have been commenced in conjunction with the clear import of the collection letter,” the lawsuit argues.
