A consumer's class action takes issue with an allegedly 'misleading and confusing' collection notice sent by Optimum Outcomes.
From Wisconsin comes a proposed class action alleging defendant Optimum Outcomes, Inc. sent a consumer a “misleading and confusing” collection notice over a balance reportedly owed to Comenity Bank. The complaint claims the notice the plaintiff received stated that the balance pertained to a “date of service” for July 1, 2016, yet in another place in the same letter stated the balance includes amounts for two accounts, with dates of service of July 1 and July 12, 2016.
“The unsophisticated consumer reading [the collection notice] could not be sure which amount Optimum was actually attempting to collect,” the complaint claims, elaborating that the defendant’s alleged conduct is “ambiguous and unclear” and in violation of the Fair Debt Collection Practices Act (FDCPA).
