A proposed class action claims the website run by Sydell Group LLC, which operates the NoMad Hotel in New York City, does not comply with the federal ADA.
The same plaintiff who filed a proposed class action against Texas Roadhouse has lent his name to a lawsuit claiming Sydell Group LLC, which operates the NoMad Hotel in New York City, violates blind individuals’ rights under the Americans with Disabilities Act (ADA) due to access barriers found within its website, TheNomadHotel.com. The 27-page lawsuit alleges the defendant, through its website, excludes blind and visually impaired individuals from full and equal participation in the growing Internet economy due to access barriers that prevent such users from independently navigating its website to make reservations.
The case alleges the plaintiff browsed and intended to book a room reservation at the NoMad Hotel but was unable to, though he allegedly intended to do so in the future once the defendant’s access barriers are remedied.
