One A Day ‘Natural’ Fruit Bites Contain Synthetic Ingredients, Class Action Says

The 22-page complaint says that companies such as Bayer have capitalized on consumers’ desire for natural products – and willingness to pay a premium for such items – by labeling the One A Day men’s and women’s dietary supplements, including the Men’s 50+ and Women’s 50+ varieties, as “natural.”
The case alleges Bayer’s “natural” representations are false, however, because of the presence of cholecalciferol, niacinamide, pyridoxine hydrochloride, d-biotin and potassium iodide in the supplements.
“Defendant’s deceptive representations and omissions are material in that a reasonable person would attach importance to such information and would be induced to act upon such information in making purchase decisions,” the lawsuit contends. “Plaintiff and the Class members reasonably relied to their detriment on Defendant’s misleading representations and omissions.”
According to the complaint, the synthetic ingredients in the One A Day supplements are manufactured through various processes that chemically change the components. The filing stresses that consumers lack the meaningful ability to test or independently verify whether a product and its ingredients are, in fact, natural simply by reading an ingredients list.
“This is because the ingredient list does not disclose the manufacturing process for each ingredient,” the suit says, noting that a reasonable consumer, moreover, is not expected or required to scour a product’s ingredients list to confirm or debunk any label claims.
The suit contests that a reasonable consumer understands Bayer’s “natural” claim to mean that the One A Day supplements are free from synthetic ingredients.
“Plaintiff and the Class members paid for Products that are natural but received Products that are not natural,” the lawsuit summarizes. “The Products Plaintiff and the Class members received were worth less than the Products for which they paid.”
The case looks to cover all consumers in California who bought the One A Day “Natural” Fruit Bites at issue between July 25, 2019 and the date the class is certified.
