Oliphant Financial, LLC finds itself on the receiving end of a lawsuit filed by a New Jersey consumer who claims he received a collection notice that failed to accurately communicate his debt dispute rights.
The suit, which seeks class action status, focuses on an April 2018 letter sent to the plaintiff regarding an obligation incurred to WebBank. According to the case, the letter omitted the fact that a debt dispute must be submitted in writing and even misleadingly invited the man to call the defendant with any issues. The complaint argues that the consumer waived his rights as he was not properly informed of how to effectively exercise his legal options.
