A Georgia resident has filed a proposed class action against Okinus, Inc. claiming the alternative financing company’s collections department violated the Telephone Consume Protection Act (TCPA) by using autodialing equipment to place calls to consumers’ cell phones. In the lawsuit, the plaintiff alleges the company utilized automatic dialing equipment that incorporates predicative algorithms that places calls dependent on when consumers are believed to be available.
Even after informing the defendant that she was not the person they intended to call and asking them numerous times to stop, the plaintiff claims the sometimes “argumentative” calls continued.
