Filed: August 3, 2018 ◆§ 2:18cv758
Audit Systems, Inc. and Metavante Payment Services have been named in a proposed class action filed by an Ohio consumer who alleges debt collection violations.
Ohio
Audit Systems, Inc. (ASI) and Metavante Payment Services, LLC have been named in a proposed class action filed by an Ohio consumer who claims she received a debt collection letter that failed to properly identify her current creditor in violation of federal law.
According to the lawsuit, Metavante – the owner of the plaintiff’s debt – contracted the collection services of ASI. The complaint alleges that in December 2017, the plaintiff received a letter from the defendants regarding her debt, which supposedly arose out from an automobile loan acquired through Toyota Financial Services. The letter allegedly listed Metavante as a “client,” but failed to explicitly identify who the current creditor was, as required by the Fair Debt Collection Practices Act (FDCPA). As such, the case argues that the letter was deceptive and misleading.
