A class action case out of Ohio claims O.E. Meyer Co. violated the anti-junk fax provision of the Telephone Consumer Protection Act (TCPA) by sending out faxes without receiving prior express permission. Further, the lawsuit alleges the defendant sent these junk faxes advertising its services without including TCPA-mandated conspicuous opt-out language, leaving the plaintiff no means of avoiding the unauthorized faxes.
