The class action settlement covers approximately 15,380 United States residents, including current and former city employees and/or residents, whose personal information was stored, possessed or controlled by Oakland and who were notified by the city of the data breach.

Class members who submit a valid claim form online or by mail or email by May 6, 2025 will be eligible to receive Oakland data breach settlement benefits.

To submit a claim form online, you will be asked to provide the unique ID and PIN found on the personalized settlement notice you should have received, the Oakland class action settlement website says.
According to the website, class members may file a claim for up to $350 per person for reimbursement of “ordinary” losses incurred as a result of the incident and supported by documentation. Per the site, these expenses may include unreimbursed bank fees, phone and data charges, postage, gas, fees for credit monitoring or identity theft protection services, costs for obtaining credit reports or credit freezes, and other miscellaneous expenses.
Consumers may also submit a claim for up to three hours of lost time spent dealing with consequences of the data breach, at a rate of $25 per hour and subject to the $350 cap for “ordinary” losses, the website shares.
Moreover, class members who claim to have been victims of fraud caused by the misuse of their personal data are also eligible to receive reimbursement for documented “extraordinary” losses, capped at $10,000 per person, the site relays.
Furthermore, Oakland settlement class members may file a claim to receive three years of three-bureau credit monitoring services provided by the city.
In addition to the aforementioned benefits, class members who served as police officers in Oakland, California, and received notice of the data breach will also be entitled to receive a $175 cash payout, the site says. Individuals will receive this cash payment regardless of whether they experienced any fraudulent activity or identity theft or sustained any identifiable losses as a result of the incident, the website adds. Per the site, these class members will also retain their right to reimbursement of relocation expenses under the California Penal Code.
The settlement agreement, which will resolve the Oakland data breach class action lawsuit, was preliminarily approved by the court on January 22, 2025.
Settlement benefits will be distributed to eligible class members if the deal is granted final approval by the court at a hearing on June 3, 2025. The final approval process may be extended by appeals that must be resolved before settlement rebates are issued.
