Per a lawsuit in New York, La Boom sent unsolicited promotional text messages to consumers' cell phones via an automatic dialing system.
The operating company of Woodside, New York Latin nightclub La Boom is on the receiving end of a proposed class action that alleges it sent unsolicited text messages to consumers’ cell phones without consent to do so. The case claims the plaintiff, after coming across a flyer on La Boom’s Facebook page, texted the defendant in October 2015 to gain free admission to a Halloween-themed event. For the next two years, and as recently as October 2017, the complaint continues, defendant La Boom Disco Inc. continued to send the man unsolicited texts, messages the man claims are sent using an automated dialing system prohibited for use in non-emergency situations.
