Computer Credit, Inc. is on the receiving end of a proposed class action lawsuit filed by a New York resident who claims the debt collector violated several provisions of the Fair Debt Collection Practices Act.
Computer Credit, Inc. is on the receiving end of a proposed class action lawsuit filed by a New York resident who claims the debt collector violated several provisions of the Fair Debt Collection Practices Act (FDCPA). According to the complaint, the defendant sent the plaintiff a collection letter that contained the following statement:
“Pay the amount due to prevent further collection activity by Computer Credit, Inc.”
The suit argues that this line overshadows the plaintiff’s right to dispute the alleged debt because it implies that payment of the amount listed is the only way “to prevent further collection activity.”
The complaint takes further issue with the defendant’s alleged failure to clearly identify the plaintiff’s creditor. The letter supposedly names “Maimonides Medical Center” as the “Provider” but never explicitly states that the entity is the plaintiff’s creditor to whom the debt is owed, the suit says.
