Gutman v. United Collection Bureau, Inc.
Filed: November 15, 2017 ◆§ 1:17-cv-06682
United Collection Bureau, Inc. has been accused in a proposed class action lawsuit of violating the Fair Debt Collection Practices Act by failing to clearly specify a consumer’s amount of debt.
United Collection Bureau, Inc. has been accused in a proposed class action lawsuit of violating the Fair Debt Collection Practices Act (FDCPA) by failing to clearly specify a consumer’s amount of debt. According to the complaint, the plaintiff received a collection letter from the defendant that contained a “Current Account Balance” but neglected to indicate whether the amount would increase over time due to interest or other added fees. The plaintiff says his account was, in fact, subject to interest, as evidenced by an earlier letter from another debt collector that referenced the same account with a lower balance. The suit claims the defendant failed its FDCPA obligation to explain the possible balance change and inform the plaintiff of information, such as the interest rate, that would allow him to calculate how much he truly owed.
