Pezzica v. Stephen Einstein & Associates, P.C.
Filed: November 10, 2017 ◆§ 1:17-cv-08769
Stephen Einstein & Associates, P.C. is on the receiving end of a proposed class action lawsuit alleging it charged a consumer an unauthorized collection fee.
New York
Stephen Einstein & Associates, P.C. is on the receiving end of a proposed class action lawsuit alleging violations of the Fair Debt Collection Practices Act (FDCPA). The plaintiff in the case, a New York resident, says he received a collection letter from the defendant indicating he owed a fee of $244.00, an amount the suit claims was “neither expressly authorized by the agreement creating the debt, nor permitted by law.” The complaint further argues that the letter contained no explanation of the added charges and failed to inform the plaintiff whether the balance in the letter would continue to increase, which it claims are required disclosures under the FDCPA.
