Immediate Credit Recovery, Inc. is the defendant in a proposed class action filed by a New York consumer who claims the defendant sent him a misleading collection letter. According to the suit, the debt collector sent the plaintiff a notice informing him that he owed $3,393.10 for spring tuition at York College. He claims the original statement from York instead stated that his tuition amounted to $2,886.10. According to the suit, the defendant had added a $507 collection fee but failed to disclose this extra charge in the letter, which could have misled the plaintiff into believing his tuition was higher than it actually was. Therefore, the complaint argues, the defendant misrepresented the character of the debt and failed to comply with the Fair Debt Collection Practices Act’s requirement that it clearly convey the amount of debt.
