NY Man Claims He Never Consented to Receive Emails from Experian

A lawsuit filed in New York claims Experian sent the plaintiff emails concerning the results of his debt dispute without consent to do so.
Experian Information Solutions, Inc. is facing a proposed class action filed in New York over alleged Fair Credit Reporting Act (FCRA) abuses. The plaintiff claims he mailed a dispute letter to Experian in August 2016 over a debt supposedly owed to Barclays. The man alleges that Experian, despite receiving a letter by mail, chose to email him a response. According to the lawsuit, the plaintiff never consented to receive notice of the results of his dispute investigation by email.
The case alleges Experian violated the FCRA because it failed to mail notice of the results of the reinvestigation of the plaintiff’s supposed debt within five business days after the completion of the reinvestigation.
